Headline: Halkbank Appeals U.S. Court Ruling
Halkbank (HALKB) has announced its intention to appeal against the decision by the Second Circuit Court on October 22, 2024, in its ongoing legal case in the United States. The bank stated its commitment to pursuing all legal avenues, including taking the matter to the U.S. Supreme Court, to seek a review of the decision.
The case against Halkbank in the U.S. began in 2021 when the Second Circuit Court ruled that the bank did not have foreign sovereign immunity. Halkbank appealed this decision to the U.S. Supreme Court, which on April 19, 2023, rejected the bank's argument for immunity under the Foreign Sovereign Immunities Act (FSIA).
However, the argument that Halkbank could not be tried in the U.S. based on U.S. common law was sent back to the Second Circuit Court for reconsideration. Upon review, the Second Circuit Court once again denied Halkbank's claim for immunity under common law and upheld the District Court's decision. Halkbank has stated its intention to use all legal rights to appeal this decision, notably addressing the U.S. Supreme Court.
